Is there anything I can do legally about someone posting blogs on the Internet about me w/o using my name?

My boyfriends ex %26amp; I got into a fight a few weeks ago. Right after the fight, she called her girlfriend over %26amp; there was more arguing and alot of threats. I went on the Internet under a fake profile and sent a friend request to the girlfriend in hopes of getting her name so I could press harrassment charges against her. She knew it was me and started sending threatening messages to my fake profile. I only responded once saying I wasn't the girl she was looking for. I have pressed charges %26amp; am waiting for court. She pressed charges on me for harrassment (saying I would kick her *** outside my house - I didn't, but told her if she attacked me I would defend myself). She is now posting blogs about me on the Internet %26amp; sending group bulletins telling everyone to read her blogs %26amp; tells that I have a fake profile %26amp; live right around the corner from her. Is there any way of stopping or prosecuting her for posting these blogs? If not, is it legal to post a blog about her w/o her name?

She (and you) can blog away provided no libel is involved. From a court's perspective, libel means "stating something as fact that isn't fact." Remember that fact is not opinion. If she says about you "She's skanky and disgusting," that's opinion, and it's fair game. If she says, "She's got HIV and is on welfare" (when neither of those are true), that's libel, and you can sue for it.





Keep in mind that, as long as she's only giving opinion, she's almost always within her rights to mention your name, too.





Welcome to the new social order. Not so new, actually--this kind of thing used to happen all the time in small towns, where people actually knew each other and had a sense of community. Now it just happens on the Internet.
Reply:you are scum of the earth. who thinks the court and police are personal body guards. how about you settle something on your own for once. without suing someone and wasting everyones time.
Reply:There is NOTHING you can do about it from a criminal law standpoint. Stay off the damn myspace crap and it wont be an issue.
